Terms of Service — GiftPage

1. Acceptance of Terms

By accessing or using GiftPage (giftpage.in), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use GiftPage. These Terms apply to all visitors, users, and others who access or use GiftPage. We reserve the right to update these Terms at any time, and your continued use of the service after any changes constitutes your acceptance of the new Terms.

2. Description of Service

GiftPage is a web-based platform that allows users to create, customize, and share gift pages using pre-designed templates. Our service includes free and premium templates, a template editor, sharing capabilities via unique links, and optional features such as custom music, photo uploads, and visual effects. GiftPage generates revenue through premium template sales and advertisements displayed on free gift pages. The service is provided "as is" and "as available" without warranties of any kind.

3. User Accounts

To access certain features, you must create an account. You can sign up using Google OAuth or email authentication. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account
Providing accurate and complete information during registration

You must be at least 13 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

You retain ownership of all content you create on GiftPage, including text, images, and other materials you upload. By creating and sharing a gift page, you grant GiftPage a limited, non-exclusive license to host, display, and distribute your content solely for the purpose of rendering and sharing your gift page. You are solely responsible for ensuring that your content:

Does not violate any applicable laws or regulations
Does not infringe on the intellectual property rights of any third party
Does not contain harmful, threatening, abusive, harassing, defamatory, or obscene material
Does not impersonate any person or entity
Does not contain malware, viruses, or any code of a destructive nature

5. Free and Premium Templates

GiftPage offers both free and premium templates. Free templates are available to all users and may include a GiftPage watermark and advertisements on the resulting gift page. Premium templates are available upon payment of the stated fee and offer additional features such as no watermark, ad-free pages, custom music, and extended link validity. Payment for premium templates is processed through Razorpay. All prices are listed in Indian Rupees (INR) and include applicable taxes. For refund information, please refer to our Refund Policy.

6. Intellectual Property

All templates, designs, graphics, code, and other creative assets on GiftPage are the intellectual property of GiftPage or its licensors. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code, unless applicable law gives you the right to do so. The GiftPage name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of GiftPage. You may not use these marks without our prior written permission.

7. Advertising

Gift pages created using free templates may display advertisements. By using free templates, you consent to the display of ads on your gift pages. We use Google AdSense for ad serving and may display contextual and personalized advertisements. You can remove ads from your gift pages by upgrading to a premium template. We are not responsible for the content of third-party advertisements displayed on gift pages.

8. Link Sharing and Public Access

When you create a gift page, it is assigned a unique shareable link (e.g., giftpage.in/your-page-name). Anyone with this link can view your gift page. It is your responsibility to share the link only with intended recipients. GiftPage is not responsible for unintended access to your gift pages if the link is shared publicly. You may delete your gift pages at any time through your dashboard, which will immediately make the link inactive.

9. Prohibited Conduct

You agree not to:

Use GiftPage for any unlawful purpose or to promote illegal activities
Attempt to gain unauthorized access to any part of the service
Use automated tools (bots, scrapers) to access or collect data from the service
Create gift pages that spam, phish, or deceive recipients
Interfere with or disrupt the service or servers connected to the service
Resell or redistribute premium templates without authorization
Circumvent any access restrictions or usage limits imposed by the service

10. Limitation of Liability

To the maximum extent permitted by applicable law, GiftPage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, data use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; or (d) unauthorized access, use, or alteration of your transmissions or content. In no event shall GiftPage's total aggregate liability exceed the amount you have paid to GiftPage in the twelve months preceding the claim.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the service will immediately cease. We will not be liable for any termination or suspension of your account. You may delete your account at any time by contacting us or through your account settings.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
