Terms of Service

1. Acceptance of Terms

By accessing or using GiftPage (giftpage.in), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use GiftPage. These Terms apply to all visitors, users, and others who access or use GiftPage. We reserve the right to update these Terms at any time. Your continued use of the service after any changes constitutes your acceptance of the new Terms. We will notify registered users of material changes via email.

These Terms constitute a legally binding agreement between you and SAHIL GANESH KAMBLE (operating the brand and platform GiftPage, hereinafter referred to as "GiftPage," "we," "us," or "our"), governed by the laws of India.

2. Description of Service

GiftPage is a web-based platform that allows users to create, customize, and share personalized digital gift pages using pre-designed templates. Our service includes free and premium templates, a template editor, sharing capabilities via unique links, and optional features such as custom music, photo uploads, and visual effects.

GiftPage operates on a credit-based system. Credits are the in-platform currency used to publish premium gift pages. Credits can be acquired through purchase packs. The service is provided "as is" and "as available" without warranties of any kind unless expressly stated.

3. User Accounts

To access certain features, you must create an account. You can sign up using Google OAuth or email authentication. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account at hello@giftpage.in
• Providing accurate and complete information during registration

You must be at least 18 years of age to purchase credits or premium templates. Users aged 13–17 may use the service with parental consent but may not make purchases. We reserve the right to suspend or terminate accounts that violate these Terms. By creating an account, you represent that you are competent to enter into a legally binding contract under the Indian Contract Act, 1872.

4. User Content

You retain ownership of all content you create on GiftPage, including text, images, and other materials you upload. By creating and sharing a gift page, you grant GiftPage a limited, non-exclusive, royalty-free license to host, display, and distribute your content solely for the purpose of rendering and sharing your gift page. You are solely responsible for ensuring that your content:

• Does not violate any applicable laws or regulations, including the Information Technology Act, 2000 and IT (Amendment) Act, 2008
• Does not infringe on the intellectual property rights of any third party
• Does not contain harmful, threatening, abusive, harassing, defamatory, or obscene material
• Does not impersonate any person or entity
• Does not contain malware, viruses, or any code of a destructive nature
• Does not constitute, promote, or facilitate any illegal activity

5. Payments, Credits & Premium Templates

GiftPage offers both free and premium templates. Premium templates require credits, which are purchased through our platform.

5.1 Payment Processing

All payments are securely processed through Cashfree Payments India Private Limited, an RBI-authorized Payment Aggregator. By making a purchase, you agree to Cashfree's terms and privacy policy in addition to ours. We do not store your card details — these are handled exclusively by Cashfree's PCI-DSS compliant infrastructure.

5.2 Pricing & Taxes

All prices are listed in Indian Rupees (INR). Applicable taxes (including GST where applicable) are included in the displayed price. Prices are subject to change with prior notice.

5.3 Credits

Credits are a non-monetary digital token used within GiftPage to publish premium gift pages. Credits have no cash value, are non-transferable, and cannot be converted back to money. Purchased credits do not expire as long as your account remains active. Credits used to publish a gift page are consumed and non-refundable once the gift page is successfully published and the share link is generated.

5.4 Refunds & Cancellations

Refund and cancellation terms are detailed in our Refund & Cancellation Policy. By making a purchase, you expressly agree to those terms.

6. Digital Delivery

GiftPage provides exclusively digital services. There is no physical delivery of any product. Upon successful payment, credits are credited to your account instantly and you can immediately publish gift pages. Details of our digital delivery process are described in our Delivery Policy.

7. Intellectual Property

All templates, designs, graphics, code, and other creative assets on GiftPage are the intellectual property of GiftPage or its licensors. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code, unless applicable law gives you the right to do so. The GiftPage name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of GiftPage. You may not use these marks without our prior written permission.

8. Ad-Free Experience

Gift pages created on GiftPage (both free and premium) are 100% ad-free. We do not display third-party advertisements or banner ads on your gift pages, ensuring an intimate, distraction-free experience for your recipient.

9. Link Sharing & Public Access

When you create a gift page, it is assigned a unique shareable link. Anyone with this link can view your gift page. It is your responsibility to share the link only with intended recipients. GiftPage is not responsible for unintended access if the link is shared publicly. You may delete your gift pages at any time through your dashboard, which will immediately make the link inactive.

10. Prohibited Conduct

You agree not to:

• Use GiftPage for any unlawful purpose or to promote illegal activities
• Attempt to gain unauthorized access to any part of the service
• Use automated tools (bots, scrapers) to access or collect data from the service
• Create gift pages that spam, phish, or deceive recipients
• Interfere with or disrupt the service or servers connected to the service
• Resell or redistribute premium templates or credits without authorization
• Circumvent any access restrictions, payment systems, or usage limits
• Engage in fraudulent transactions or chargebacks without genuine disputes
• Use the platform to create content that violates Section 67 of the IT Act, 2000 (obscene material) or any other applicable Indian law

11. Limitation of Liability

To the maximum extent permitted by applicable law, GiftPage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, resulting from: (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; or (d) unauthorized access, use, or alteration of your transmissions or content. In no event shall GiftPage's total aggregate liability exceed the amount you have paid to GiftPage in the three months preceding the claim.

12. Disclaimers

GiftPage provides the service on an "as is" and "as available" basis without any express or implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses. Cashfree Payments, Google, and other third-party service providers operate independently and GiftPage is not responsible for their service availability or policies.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the service will immediately cease. Unused credits at the time of termination due to policy breach will be forfeited. You may delete your account at any time by contacting us at hello@giftpage.in.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, including the Indian Contract Act 1872, the Information Technology Act 2000, the Consumer Protection Act 2019, and the Digital Personal Data Protection Act 2023. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India.

In accordance with the Information Technology Act, 2000 and rules thereunder, and the Consumer Protection Act, 2019, the name and contact details of the Grievance Officer are provided below. You may contact the Grievance Officer for any complaints or concerns relating to the platform or these Terms.
